Terms and COnditions
These general Terms and Conditions ("Terms and Conditions" or "T&C") shall be valid for all betting games offered by Oat Gaming trading under the name and trademark “Oatbet” (a company duly registered under the laws of Nigeria, with company registration RC 1664029)
Oatbet shall offer betting services through various channels not limited to Website, POS, SMS, USSD hereon referred to as ‘the service".
By using the service you are bound by the following terms and conditions:
The Terms and Conditions contained herein represent the complete, final and exclusive agreement between the Customer and the Company and supersede any and all prior agreements, representations, understandings, statements made by its agents and its employees
By using the service the Customer confirms that he/she has reached the age of 18 or such legal age as he/she must have reached under the laws governing betting that are applicable to him/her. Irrespective of national regulations concerning the legal age, however, Oatbet does not accept any Users under the age of 18. Oatbet reserves the right to verify any Customer's statement of age and to exclude Customers from its services, if there are any doubts regarding the attainment of the minimum age required. Any Customer using our services, who is identified as underage, shall have all his winnings forfeited and his/her (betting) account (hereinafter referred to as the "Account" shall be blocked immediately.
Non-Commercial, non-professional purposes: the Customer´s interest in using the service is of a personal nature, and is to be used purely for personal entertainment. Any commercial and professional interest is discarded.
Oatbet does not warrant the constant availability and functionality of all or any products offered by Oatbet. Oatbet may not be held liable and will be held harmless by the Customer for any damages, losses, costs, loss of profits or any other disadvantage a Customer may incur in connection with any disconnection from or the non-availability of any of the products offered by Oatbet for whatever reason.
Oatbet cannot be held liable in any case for any damage or loss caused directly or indirectly by the service or by its contents or by the contents provided by a third party, unless they are based on intentional or gross negligence.
Oatbet shall not be liable if the Customer is unable to place a bet due to congestion on the sums system or any other electronic communication media used for the purposes of betting.
All indicated dates and times are based on WAT (West Africa Time) unless stipulated otherwise.
The betting service is only available in Nigeria and in Nigerian Naira (NGN) only.
Registering An Account
To play at Oatbet, you will need to first register for an account by choosing a unique username and password and entering other information such as your first and last name, full address, email address, date of birth and telephone number. Only true and current information must be submitted and this information must be updated as necessary to keep it true and current.
Participation in Betting or Games is forbidden for whomever and/or wherever prohibited by law. All players must be the legal age of majority in their jurisdiction or at least 18 years of age if no age of majority is specified (whichever is greater). No persons under this age limit are permitted to use the Oatbet website or services in any way. Oat Gaming Limited. shall not be held responsible for any false information provided by the user with regards to age or legal capacity to use the Oatbet website. Oat Gaming Limited. reserves the right to ask the Account Holder for proof of age at any time it deems necessary.
An applicant can only use Nigerian Naira.
Oat Gaming Limited. allows only one account per person and these details are stored and checked in our database periodically. Should we have reasonable suspicions that any Account Holder has opened multiple accounts with us we reserve the right in our absolute discretion to freeze that account or to close the account immediately and the customer shall forfeit all his winnings. Account Holders should also note that their original deposits will not be refunded. Account Holders shall also be liable towards Oat Gaming Limited. for damages and costs incurred as a result of the fraud. All new registrations are monitored to ensure that duplicate accounts are not created.
Every holder shall treat his account as a bank account and must be discrete about the password. However, when making withdrawals, account holders may select any account they wish their withdrawal to be transferred into.
To maintain a high level of security, Oat Gaming Limited. reserve the right to conduct a security review at any time, especially prior to processing the Account Holder’s withdrawal request, to validate identity and financial transactions. To facilitate these security checks, Account Holders will be asked to provide such identification or other information or documentation as Oat Gaming Limited. deems necessary. If Account Holders fail to comply with any security request, Oat Gaming Limited. reserves the right to void the Account and freeze the account’s monetary balance. Account Holders will be notified of such verification request by electronic mail and Account Balances will be forfeited if the requested documentation is not provided within 7 days.
The necessary documentation to verify your account include but is not limited to:
• A scanned image of Passport or Government issued ID
• A recent Utility Bill or Bank Statement showing clearly your Name and Address.
• A copy of the front and back of the Bank card used on your account showing the first 6 and the last 4 digits present on the front of the card. Please ensure the last 3 digits at the back of the card are hidden (if applicable)
• Proof of ownership of the bank account in your name
Oat Gaming Limited recommends that Account Holders send us their official personal identification documents even if this is not requested. This will facilitate matters at withdrawal stage. Account Holders wishing to send us such documents of their own free will may do so by emailing them to cs@Oatbet.com
Managing An Account
Account Holders may access their account online by visiting www.Oatbet.com and entering their Username and Password. The Account Holder is obliged to keep his/her Username and Password private and confidential. Any unauthorized use of the Username or Password shall be the sole responsibility of the Account Holder. Account Holders should not allow third parties to access or to make use of their account. Using personal details pertaining to third parties even with their permission is a serious offence. By opening a Oatbet account and by placing a bet, the User warrants that he/she has reached the minimum legal age for participation. In addition by opening a Oatbet account and by placing a bet, the User confirms that he or she retains the legal capacity to enter into an agreement with the Company. If one of these conditions is not respected the User's account will be closed and all other necessary measures will be implemented.
The Account Holder has the absolute obligation to notify in writing by sending an email to our Security Team in case s/he discovers the unlawful or unauthorized use of his/her Username and Password. Any liabilities arising from such matters shall be the sole responsibility of the Account Holder.
To place bets and gamble on Oatbet, Account Holders are required to deposit funds into the Account by any of the methods specified at Oatbet website, which may change from time to time in Company’s sole discretion. Generally, funds will be promptly deposited into your Account upon actual receipt of funds by Company and/or its agents.
Maximum and minimum limits apply to deposits depending on your history with Oatbet, the method of deposit, and as determined solely by the Company. All funds will be paid, tracked and maintained in the currency chosen upon registration and shall not bear interest.
By funding their Oatbet gaming account, Account Holders also acknowledge that any payments made with any depositing option available, in particular Debit/Credit Cards, are irrevocable. In addition, the name on your Account must match your true and legal name, and identity and the name that is provided on your Account registration must match the name that is found on any payment account used to transfer monies into and out of your Account unless you have elected to use a different account when placing a withdrawal request.
May engage third-party electronic payment processors and/or financial institutions “Payment Processors” to process transactions related to your Account. You hereby authorize Oat Gaming Limited to instruct such Payment Processors to handle deposits and withdrawals from your Account in accordance with requests made by you using the Services. You shall be bound by the terms and conditions of the Payment Processors. Oat Gaming Limited. shall not be liable for unlawful behavior or misconduct of any Payment Processor.
In order to discourage Money Laundering, withdrawal requests for funds that were deposited without game play history will not be processed
You fully understand and agree to be bound by these terms and conditions and as modified and/or changed from time to time. Oatbet reserves the right to modify and amend these Terms and Conditions at any time with or without notice. Such amendments will become effective immediately upon being posted at Oatbet.com. It is your sole responsibility to review these Terms and Conditions and amendments hereto each time you play. Accounts may be suspended if frequent withdrawal requests are made without a history of game-play and the company has the right to freeze the account and hold the money until it has done a full investigation into the account.
All amounts cashed out are subject to the transaction limits and processing fees if applicable as set forth by Oat Gaming Limited. and may change from time to time in Company’s sole discretion. Further, the Company may report and withhold any amount from winnings as required by law, and in any event, all federal, state and local taxes due in connection with any winnings awarded to you are your sole liability.
Payment of funds cashed out can be made by bank wire, e-wallets and/or any other manner which the Company selects in its sole discretion. Requests equal to or greater than N250,000 (Two Hundred and fifty thousand Naira) will require you to submit a valid form of identification along with proof of a physical/billing address. Also, a cumulative total of N250,000 (Two Hundred and fifty thousand Naira) in deposits, withdrawals or transfers may require the account to be verified. Payments will be made as promptly as possible, subject to any necessary security reviews by the Company.
It is prohibited for Customers to buy, sell or transfer accounts to other Customers.
Every Customer may only open one account with us. Oatbet retains the right to close the betting account of any Customer who has opened multiple betting accounts under his/her name or under different names. If we have reasonable grounds to believe that multiple betting accounts (also under different names) have been opened with the intention of defrauding the Company, we retain the right to cancel any transaction related to the said fraud attempt.
After opening an account the Customer must keep username, password and/or account number a secret. All transactions where your username and password and /or account number have been entered correctly will be regarded as valid whether or not they have been authorized by the registered Account holder. Any account registration may be subject to KYC processes. The Company shall not be liable for any claims in the event that the Player gives away, tells, shares or loses his/her username, password or account number.
In accordance with the legal period of warranty requested by law all the personal details saved in our system will only be deleted at your express request after the expiration of the respite period of seven (7) years.
Oatbet reserves the right to cancel your Oatbet account for any reason whatsoever at any time without notice to you and reserves the right, in its discretion, to void any winnings and confiscate any balance in your Oatbet account in any of the following circumstances:
a) If you have more than one active account at Oatbet
b) If the name on your Oatbet account registration does not match the name on the credit/debit card(s) or other payment accounts used to make purchases or withdrawals at Oatbet and for which supporting documentation is not provided when requested.
c) If you provide incorrect or misleading registration information
d) If you are not of legal age
e) If you connect from a jurisdiction where participation in the games is prohibited by law
f) If your account has been used for fraudulent or money laundering purposes
g) If you are found making use of robotic, mechanical, or electronic or other devices to automatically make decisions in any game offered on Oatbet.com website.
h) If you are found cheating or been involved in collusion or chip dumping.
i) If you have “charged back” or denied any of the purchases or deposits that you have made to your Account
j) If you fail to comply with any of the terms and conditions set forth
k) If Oatbet. Should become aware that you have played at any other online gaming site under any of the circumstances set out at a) to j) above.
l) If your Oatbet account is linked to any Oatbet account that failed to comply with ANY articles mentioned above.
m) If you have made an initial deposit to attract a welcome bonus and attempted to make a withdrawal
Customer is not allowed to transfer funds from his/her Account to other Users or to receive money from other Users into his Account, or to transfer, sell and/or acquire, user accounts.
If, in the Company’s sole determination, you are found to have cheated or attempted to defraud the Games, Oatbet, or Oat Gaming Limited. in any way, including but not limited to game manipulation or payment fraud, or if you make untrue and/or malicious comments with regards to Company’s operation, Company reserves the right to publicize your actions. Further, the Company may close accounts, and forfeit account balances, that you have at Oatbet.
Furthermore, a person found to have been involved in fraud, dishonesty or online criminal acts of any kind will be required to indemnify Oat Gaming Limited. for any losses or costs sustained, arising directly or indirectly from such actions.
All financial transactions are constantly monitored and any suspicious transactions will be reported to the authorities concerned.
Abusive or offensive language will not be tolerated with Company staff. Any violation of this policy will result in a suspension of playing privileges or such other action as may be required by Company to ensure compliance.
Please note that:
Funds deposited are valid indefinitely, but if no transaction has been recorded in a Oatbet account for twelve (12) months, Oatbet shall remit the balance in that account to the Account Holder deducting a service charge of N10,000 (Ten Thousand Naira) for every month.
Oatbet will only accept bets made online and through a registered user that have generated a Oatbet Betslip or Coupon ID, bets will not be accepted in any other form. The following rules will apply to the accepting of bets:
• You must make sure that the details of your bets are correct because once they have been placed with us and accepted, they cannot be cancelled or changed by you.
• Bets will not be considered as accepted until they are reviewed by our Odd Compilers. For which confirmation may be obtained by accessing the betting list from your gaming account. Only in such cases, the coupon is considered as accepted.
• Should any dispute arise regarding bets placed online, then the transaction log in the database will be examined and this will determine the dispute.
• Oatbet reserves the right to refuse all, or part, of any bet requested without notification.
• It is at the Account Holder’s discretion to ensure whether a bet was accepted or refused Oat Gaming Limited. reserves the right to suspend a market at any time.
• Bets will be processed in the order in which they are received.
Customers must register their bet requests as individuals. Repeated requests containing the same selections from the same or different customers may be subsequently deemed void in the following circumstances:
Where Oat Gaming Limited believes the customers are acting in collusion or as a syndicate.
Where bet requests are registered within a short time of another.
In any one of the cases, Oat Gaming Limited. may pay out only an amount that would have been accepted for one customer placing one bet. Oat Gaming Limited. will inform the customer by e-mail, phone or telefax and the intended stake will be left on the customer's betting account. Where a selection is made void, in Single bets the stakes will be returned. In accumulative bets, the stake will stand for the remaining selections with a Double becoming a Single, a Treble becoming a Double etc.
The “possible winnings” section is for information only and all bets will be settled upon the basis of the stake at the accepted odds.
Should your selection include a non-runner or a void selection in a multiple bet, then the bet will be settled on the basis of the remaining selections.
Unless otherwise stated in these special Rules, the result of a sports event or race will be that which is declared by the relevant sport's governing body immediately upon the conclusion of the event. If a subsequent enquiry results in an alteration to the previously declared result, then notwithstanding this outcome, the original settlement of bets will stand. For example, horseracing bets will be settled on the basis of the official result at the weigh-in and will not be affected by any subsequent enquiries.
If the venue for any sporting event is changed, then all bets placed prior to the announcement of the change will be void.
The times of the events cited on the website are only indicative and subject to change by various sports federation. Consequently, bets inadvertently placed after the start of an event will be considered invalid, without prejudice to the other events which may be included in a multiple bet.
We reserve the right to delay a winning to validate if the bet was placed after the game had started.
If we find the instructions to be ambiguous and the ambiguity cannot be resolved before the start of the event then we reserve the right to void the bet, win or lose.
The live timer is used to ascertain that a bet cannot be placed before a goal or an important event during the match (e.g. Sent off).
For display purposes, the odds are reported to two decimal places. When multiplied they often generate a number beyond the cent. In this case, the following rule of rounding is used: 0.0 to 0.4 is rounded to 0.0; 0.5 to 0.9 is rounded up to 1.0.
The system calculates the winnings with high precision and then rounds the values. For instance, if the total odds are 101.2987, it will be displayed as 101.3.
Winnings are however calculated on the original odds and not the rounded figure. An instance is depicted below;

All bets placed on a bookmaker are a gambling agreement between the bettor and the Company. Up to the time of suspension of bets accepted by Oatbet, all bets previously placed must be considered as a registered contract and therefore cannot be deleted.
If a bet needs to be evaluated by the trader, Oatbet reserves the right to reject the bet if the stake is deemed excessive or the bet placed is not aligned with the market.
The maximum winnings for any one customer in any one day in-shop and online shall be Forty Million Naira (N40,000,000).
Payout limits apply to each customer or group of customers who play the same or similar selection or combination of selections, even though divided into a series of bets, at different odds and even if carried out on different days or at different locations. If Oatbet suspects that one or more bets have been made following this procedure, Oatbet reserves the right to withdraw from these contracts considered abnormal and the total payment will be limited to a one-time the maximum payout as above listed. Oatbet reserves the right to publish the information of any winner that wins above One Million Naira (1,000,000) on Sports and or Two Hundred Thousand Naira (N200,000) on Virtual for marketing purposes. Oatbet also reserves the right to invite the winner to our offices to take photographs to be used for marketing purposes before payment of the winning.
If winnings are credited to an account for payment in error and are used as stakes, then Oat Gaming Limited. (Oatbet) reserves the right to void any transactions involving such funds.
In the event that Oatbet does not have an official statement by any official federation authority within 48 hours of the end of the game, we reserve the right to cancel the bet.
EX AEQUO RULE:
An "ex aequo” occurs when two or more participants in an event come in a tie for first and second place.
In the event of two selections that end in an "ex aequo", the client’s bet is divided, with half of the stake applied to the winning selection and the other half lost.
With more than two selections, the stake is divided proportionally.
The presence or absence of specific information on any event being bet on, such as events played on "neutral fields" or any changes to the playing surface, will not be cause for cancellation or refund of the bet. It is the bettor’s responsibility to be informed on such updates regarding the event being bet on.
WINNINGS ABOVE N250,000
In compliance to EFCC KYC (Know Your Customer) Policy, Oat Gaming Limited(Oatbet) will require a valid means of identification to enable us to process a withdrawal request for such winning. The acceptable valid means of identification are driver's license, international passport, national identity card, or voter's card. If the event that we do not receive the required document, Oat Gaming Limited(Oatbet) reserves the right to hold the winning till validation is complete.
ANTE-POST/ OUTRIGHT/ WINNING
The rule of "non-runner" concerns the revision of odds on bets placed that result won in the case that one or more competitors in the market do not participate, retires or should be excluded from the event. In this case, a reduction factor will be applied to the odds of the remaining participants of the event. The reduction factor will be calculated taking into account his winning probability which will then be applied to the winning bets.
The reductions will be applied to placed bets.
Example: If the final reduction factor of a non- runner is equal to 25% of the value of the average odd placed (fixed odd equal to 4), the bets placed will be reduced by 25%, therefore a placed bet with odd at 8.00 will become of 6.00 and so on and so forth. If another player does not participate, retires or is excluded from the event, such values can be further reduced.
The 'reduction factor' established will be applied at Oatbet’s discretion.
For any event where a specific rule is not specified on the Oatbet site, all decisions on such event will be up to Oatbet’s discretion.
All the results and statistics are sent by BetRadar.com. All the bets are settled once official results are sent by BetRadar.com. Statistics provided by the official score(s) provider or the official website of the relevant competition or fixture will be used to settle wagers. Where statistics from an official score(s) provider or official website are not available or there is significant evidence that the official score(s) provider or official website is incorrect, we will use independent evidence to support bet settlement. Should there be an incorrect result Oatbet reserves the right to delay the payout of the winning until it has completed its investigation. In the case of an incorrect ODD Oatbet reserves the right to reduce the odds to the correct amount at is sole discretion using the average of 3 websites of its choice.
Deposits and Withdrawals
The Customer has the possibility to increase the balance of his account with one of the payment methods made available by Oatbet. The Customer can similarly withdraw the residual balance using a payment method provided by Oatbet.
Withdrawals will be remitted to the account that the user enters when requesting the withdrawal. Withdrawals may be subject to the details of the account holder matching the details of the user. No withdrawal will be authorized if it appears to be linked with transactions predominantly performed with the purpose of allowing the transfer of money from a payment means to another. If such a circumstance occurs, the relevant amount may only be remitted to the player through the same payment means from which the money deposited into the player’s account originated.
In order to perform any transaction Oatbet may undertake any such verification checks as may be required by ourselves or by third parties (including, but not limited to, regulatory bodies) to confirm the legal ownership and the origin of the money implicated, the identity of the applicant and to comply with the relevant Anti Money Laundering Provisions.
In order to withdraw your money, you might be requested to send us a copy of your ID (front/rear). Whenever a transaction is made through bank transfer, credit card or electronic wallet, the first withdrawal request will be processed only after a security check has been performed. In such instances you may be required to supply the following papers together with the ID, in order to comply with our security policies:
• In case of card transactions, a copy of both sides of each of the cards used duly signed by the owner;
• A copy of an official document showing your billing address if it differs from the one registered in the ID;

Payouts handled manually through an ordinary bank transfer are processed within 5 banking days. However, the Customer acknowledges that the Banks determines when the payment is made and Oatbet cannot do anything to speed up this process. As an alternative, withdrawals through QuickTeller transfer etc. are usually processed within 24 hours from the request. Oatbet reserves the right to carry out additional verification procedures for pay-outs exceeding a certain amount, or when there is a suspicion of misuse of accounts or money laundering.
The Customer agrees not to attempt any charge-backs, reversals or otherwise cancel any deposit previously made in his/her Account. Whenever any such event should occur the Customer commits to refund Oatbet for the unpaid deposits and for possible expenses resulting from the recollection of the misplaced money.
Oatbet will hold the funds deposited in the Account as trustee for the Customer and not as his/her banker or debtor. Accordingly, there will be no obligation on the part of Oatbet to repay money to the Customer as his/her debtor.
Oatbet reserves the right to limit or to refuse bets.
Funds deposited in the Account, as well as winnings or other amounts not yet credited, shall not attract any interest.
Oatbet may delay the withdrawal of any funds if they have a reason to believe that the winning amount is incorrect to allow them to investigate.
In order to discourage Money Laundering, withdrawal requests for funds that were deposited without game play history will not be processed.

- The maximum bonus amount that can be turned to real and be withdrawn is capped at NGN 50,000.

- In the unlikely event that a bet is re-opened, the operator reserves the right to specify the total contribution amount from that bet.

- Voided bets canceled bets and bets that have been cashed out are non-contributing.

- Bet containing events finishing after the bonus expiry date will not be contributing.
- Promotional offers are limited to per person, family, household address, email address, telephone number, same payment account number, and shared computer, e.g., public library or workplace. The operator reserves the right to forfeit the offer availability if the player is deemed to have already participated in the promotion.
- Offers only apply to customers who have made a real money deposit with the operator. CONTRIBUTING / NON-CONTRIBUTING BETS
We will refer to contributing bets as bets that are counted towards meeting the turnover requirements. Non-contributing bets do not count towards meeting the requirements.
Single and double bets are non-contributing.
Combination bets are non-contributing.
Each selection must have minimum odds of 1.5
You would not be able to withdraw winnings from the bonus given without wagering on five (5) events or more on a bet slip with the bonus value given.

In the unlikely event that a bet is re-opened, the operator reserves the right to specify the total contribution amount from that bet.
Voided bets, canceled bets, and bets that have been cashed out are non-contributing.
A bet containing events finishing after the bonus expiry date will not be contributing.
Selections whose results are voided, half-won, or half-lost are not added to the contribution criteria of that bet. For example, if a Draw-No-Bet is placed and a stake is given back due to a draw, such selection will not be counted. Nevertheless, if the other selections do meet the criteria, then the odd is contributing.
The contribution on won bets is only added after confirming that the contributing criteria are still valid and have not changed since the placement time.
Any bet with a similar set of events placed previously in another bet will not be eligible.
If evidence of a breach of the promotion rules is verified, or the operator deems that the bets placed guarantee customer winning regardless of the results of events, the operator reserves the right to forfeit the bonus amount from the offer.
In the unlikely event that bonus money has been released before a reopening of events, the operator reserves the right to reclaim the released bonus amount.
Promotional offers are limited to per person, family, household address, email address, telephone number, same payment account number (e.g. debit or credit card, Interswitch account, etc), and shared computer, e.g. public library or workplace. The operator reserves the right to forfeit the offer availability if the player is deemed to have already participated in the promotion.

If any provision of these Terms and Conditions is found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of these Terms and Conditions which shall remain in full force and effect.
In such instances, the part declared invalid or unenforceable shall be amended in a manner consistent with the applicable law to reflect, as closely as possible, Oatbet's original intent.
Applicable Law and Place of Jurisdiction
Any bet placed by the Customer shall be governed by the applicable provisions of the Administration of Criminal Justice Act 2015 and or any other applicable Laws and any Regulations and Rules made in terms thereof, as amended from time to time. It shall be the responsibility of the Customer to ensure that he/she is aware of these provisions.
If the Customer places of a bet from a location falling outside Nigeria, such bet shall be subject to all appropriate exchange control regulations and the laws of the foreign jurisdiction from which such communication originates and it shall be the responsibility of the Customer to ensure full compliance with same. Oatbet makes no warranties and shall not be liable to the Customer if it is not able to remit any monies held by it to any account held by the Customer in a foreign jurisdiction.
Virtual Sports is a computer generated presentation of a random result. Oatbet will refund any Virtual Racing bets made on events without results, incorrect results or bets placed after the event has started due to technical circumstances that lie outside our control.
Bets, tickets and draws can be voided and/or canceled by a user or due to internet interruptions or technical failures. In these cases, the bets are no longer valid [irrespective of the outcome] and such tickets will be refunded in full.

1. Some circumstances may arise where a bet is confirmed, or a payment is performed, by us in error. The following is a non-exhaustive list of such circumstances:
• Whenever the prices/spreads/terms offered by Oatbet are significantly dissimilar from those available in the general market,
• Whenever the prices/spreads/terms offered at the time the bet is placed are clearly wrong given the probability of the forecast occurring,
• Whenever a bet has been erroneously accepted on a market which should have been suspended or removed,
• Where a bet containing incompatible events is accidentally accepted, because of human or technical error,
• Whenever a settlement error is made while computing or crediting the amount of winnings,
• Any other situation that may be referred to as an error.
In all these cases Oatbet reserves the right to cancel all the bets accepted containing such an error, or to correct the mistake made re-settling all the bets at the correct prices/spreads/terms that should have been available at the time that the bet was placed in the absence of the error.
The Customer has an obligation to inform Oatbet as soon as possible of any amount wrongly credited on his/her account. Oatbet may at any time set off any positive balance resulting from the erroneous operation, as well as cancel possible bets or transactions made with the erroneously credited funds.
Neither we (including our employees or agents) nor our partners or suppliers are liable for any loss resulting from any error made. Bets placed in order to cover flawed bets will stand valid if not impaired by errors.
In the event that, due to technical problems, the printed version of a document or of a coupon differs from the web version, the latter shall prevail.
In the event of any dispute, the Customer agrees that the records of our server shall act as the final authority in determining the outcome of any claim.
Oatbet shall have the right prior to accepting any bet, temporarily to suspend or permanently to terminate, the provision of betting services to a Customer without providing any reason.
Data Protection Policy
1.1 We believe that everyone has rights with regard to the way in which their personal data is handled. During the course of our activities, we will collect, store and process personal data about our customers, suppliers and other third parties, and we recognise that the correct and lawful treatment of this data will maintain confidence in our organisation and will facilitate successful business operations. In furtherance of this belief and with the objective of perpetuating a regard for Data Subjects and their Personal Data, the Board of Oat Gaming Limited (‘Oatbet’, ‘Company’, ‘We’, or ‘Our’) has approved this Data Protection Policy (‘Policy’) under the guidance of the Nigeria Data Protection Regulations issued by the National Information Technology Development Agency (‘NITDA Regulations’).
1.2 Data Administrators and Data Processors (‘Data Users’) are obliged to comply with this Policy when processing personal data on our behalf. Any breach of this policy may result in appropriate disciplinary action.
About this policy
2.1 The types of personal data that Oat Gaming Limited (‘Oatbet’, ‘Company’, ‘We’, or ‘Our’) may be required to handle include information about current, past and prospective punters, suppliers, customers, and others that we communicate with. The personal data, which may be held on a computer or other media, is subject to certain legal safeguards specified in the NITDA Regulations and other regulations (‘the Regulations’)
2.2 This Policy and any other documents referred to in it sets out the basis on which we will process any personal data we collect from data subjects or that is provided to us by data subjects or other sources.
2.3 This Policy does not form part of any employee's contract of employment and may be amended at any time.
2.4 This Policy has been approved by the Board of the Company. It sets out rules on data protection and the legal conditions that must be satisfied when we obtain, handle, process, transfer and store personal data.
2.5 The Data Protection Officer is responsible for ensuring compliance with the Regulations and this Policy. The post will be held by such officer as may be designated by the Company from time to time. Any questions about the operation of this policy or any concerns that the policy has not been followed should be referred in the first instance to the Data Protection Officer. Definition of terms
3.1 Data means characters, symbols and binary on which operations are performed by a computer. Which may be stored or transmitted in the form of electronic signals is stored in any format or any device.
3.2 Data Subjects for the purpose of this policy means an identifiable person; one who can be identified directly or indirectly, in particular reference to an identification number or to one or more factors specific to his physical, physiological, mental, economic, cultural or social identity.
3.3 Personal Data means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person; It can be anything from a name, address, a photo, an email address, bank details, posts on social networking websites, medical information, and other unique identifier such as but not limited to Media Access Control (MAC) address, Internet Protocol (IP) address, International Mobile Equipment Identity (IMEI) number, International Mobile Subscriber Identity (IMSI) number, Subscriber Identification Module (SIM) and others.
3.4 Data Controllers means a person who either alone, jointly with other persons or in common with other persons or as a statutory body determines the purposes for and the manner in which personal data is processed or is to be processed. We are the Data Controller of all Personal Data used in our business for our own commercial purposes.
3.5 Data Administrators are those of our employees and agents whose work involves processing Personal Data. Data Administrators must protect the data they handle in accordance with this Policy and any applicable data security procedures at all times.
3.6 Data Processors include any person or organisation that is not a data user that processes Personal Data on our behalf and on our instructions. Employees of data controllers are excluded from this definition but it could include suppliers who handle Personal Data on our behalf.
3.7 Processing means any operation or set of operations which is performed on Personal Data or on sets of Personal Data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
3.8 Regulation means the NITDA Regulations and its subsequent amendments and where circumstance requires it shall also mean any other Regulations on the processing of information relating to identifiable individual’s Personal Data, including the obtaining, holding, use or disclosure of such information to protect such information from inappropriate access, use, or disclosure.
3.9 Sensitive Personal Data includes information about a person's racial or ethnic origin, political opinions, religious or similar beliefs, trade union membership, physical or mental health or condition or sexual life, or about the commission of, or proceedings for, any offence committed or alleged to have been committed by that person, the disposal of such proceedings or the sentence of any court in such proceedings. Sensitive Personal Data can only be processed under strict conditions, including a condition requiring the express permission of the person concerned.
3.10 Third-Party means any natural or legal person, public authority, establishment or any other body other than the Data Subject, the Data Controller, the Data Administrator and the persons who are engaged by the Data Controller or the Data Administrator to process personal data.
4. Data protection principles
4.1. Anyone processing personal data must comply with the enforceable principles of good practice. These provide that Personal Data must be:
(a) Collected and processed fairly and lawfully.
(b) Processed for limited purposes and in an appropriate way.
(c) Adequate, relevant and not excessive for the purpose consented to by the Data Subject.
(e) Not kept longer than necessary for the purpose.
(f) Processed in line with Data Subjects' rights.
(g) Secured against foreseeable hazards, breaches such as theft, Cyber attack, viral attack, dissemination, manipulations of any kinds, damage by rain, fire or exposure to other natural elements.
(h) Not transferred to people or organisations situated in countries without adequate protection.
4.2 Anyone who is entrusted with the Personal Data of a Data Subject or who is in possession of the Personal Data of a Data Subject shall be accountable for his acts and omissions in respect of data processing and in accordance with the principles contained in this Policy.
Fair and lawful processing
5.1. The Policy is not intended to prevent the processing of Personal Data but to ensure that it is done fairly and without adversely affecting the rights of the Data Subject.
5.2. For Personal Data to be processed lawfully, they must be processed on the basis of one of the legal grounds set out in the Regulations. These include, among other things, the Data Subject's consent to the processing, or that the processing is necessary for the performance of a contract with the Data Subject, for the compliance with a legal obligation to which the Data Controller is subject, or for the legitimate interest of the Data Controller or the party to whom the data is disclosed. When Sensitive Personal Data is being processed, additional conditions must be met. When processing Personal Data as Data Controllers in the course of our business, we will ensure that those requirements are met.
Processing for limited purposes
6.1. In the course of our business, we may collect and process the Personal Data set out in the Schedule. This may include data we receive directly from a Data Subject (for example, by completing forms or by corresponding with us by mail, phone, email or otherwise) and data we receive from other sources including, for example, business partners, sub-contractors in technical, payment and delivery services, credit reference agencies and others.
6.2. We will only process Personal Data for the specific purposes set out in the Schedule to this Policy or for any other purposes specifically permitted by the Regulations. We will notify the Data Subject of those purposes when we first collect the data or as soon as possible thereafter.
Notifying data subjects
.1. If we collect Personal Data directly from Data Subjects, we will inform them about:
(a) The purpose or purposes for which we intend to process Personal Data.
(b) The types of third parties, if any, with which we will share or to which we will disclose that Personal Data.
(c) The means, if any, with which Data Subjects can limit our use and disclosure of their Personal Data
7.2. If we receive Personal Data about a Data Subject from other sources, we will provide the Data Subject with this information as soon as possible thereafter.
7.3. We will also inform Data Subjects whose Personal Data we process that we are the Data Controller with regard to that data, and the contact details of the Data Protection Officer.
Adequate, relevant and non-excessive processing
We will only collect Personal Data to the extent that it is required for the specific purpose notified to the Data Subject.
We will ensure that the Personal Data we hold is accurate and kept up to date. We will check the accuracy of any Personal Data at the point of collection and take reasonable steps to destroy or amend inaccurate or out-of-date data upon being notified by the Data Subject.
We will not keep Personal Data longer than is necessary for the purpose or purposes for which they were collected. We will take all reasonable steps to destroy, or erase from our systems, all data which is no longer required.
Processing in line with data subject's rights
We will process all Personal Data in line with Data Subjects' rights, in particular, their right to:
(a) Request access to any data held about them by a data controller.
(b) Prevent the processing of their data for direct marketing purposes.
(c) Ask to have inaccurate data amended.
(d) Prevent processing that is likely to cause damage or distress to themselves or anyone else.
(e) Withdraw consent at any time, provided that the withdrawal of consent shall not affect the lawfulness of processing based on consent prior to the withdrawal
12.2. We will put in place procedures and technologies to maintain the security of all Personal Data from the point of collection to the point of destruction. Personal Data will only be transferred to a data processor if he agrees to comply with those procedures and policies, or if he puts in place adequate measures himself.
12.3. We will maintain data security by protecting the confidentiality, integrity and availability of the Personal Data, defined as follows:
(a) Confidentiality means that only people who are authorized to use the data can access it.
(b) Integrity means that Personal Data should be accurate and suitable for the purpose for which it is processed.
(c) Availability means that authorized users should be able to access the data if they need it for authorized purposes. Personal Data should, therefore, be stored on Company’s central computer system instead of individual personal computer systems.
12.4. Security procedures include:
(a) Entry controls. Any stranger seen in entry-controlled areas should be reported.
(b) Secure lockable desks and cupboards. Desks and cupboards should be kept locked if they hold confidential information of any kind. (Personal information is always considered confidential.)
(c) Methods of disposal. Paper documents should be shredded. Digital storage devices should be physically destroyed when they are no longer required.
(d) Equipment. Data Users must ensure that individual monitors do not show confidential information to passers-by and that they log off from their computers or other information technology systems when it is left unattended.
Transferring personal data to a foreign country
13.1 We may transfer any Personal Data we hold to a country outside Nigeria, provided that one of the following conditions applies:
(a) Subject to the provisions of the NITDA Regulations, the country to which the Personal Data is transferred ensures an adequate level of protection for the Data Subjects' rights and freedoms.
(b) The Data Subject has given his consent.
(c) The transfer is necessary for one of the reasons set out in the NITDA Regulations, including the performance of a contract between us and the Data Subject, or to protect the vital interests of the Data Subject.
(d) The transfer is legally required on important public interest grounds or for the establishment, exercise or defence of legal claims.
(e) The transfer is authorised by the relevant data protection authority where we have adduced adequate safeguards with respect to the protection of the Data Subjects' privacy, their fundamental rights and freedoms, and the exercise of their rights. 13.2 Subject to the requirements in clause 13.1 above, Personal Data we hold may also be processed by staff operating outside Nigeria who works for us or for one of our suppliers. That staff maybe engaged in, among other things, the fulfilment of contracts with the Data Subject, the processing of payment details and the provision of support services.
Disclosure and sharing of personal information
14.1 We may share Personal Data we hold with any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 338 the Companies and Allied Matters Act 2004.
14.2 We may also disclose Personal Data we hold to third parties:
(a) In the event that we sell or buy any business or assets, in which case we may disclose Personal Data we hold to the prospective seller or buyer of such business or assets.
(b) If we or substantially all of our assets are acquired by a third party, in which case Personal Data we hold will be one of the transferred assets.
14.3 We may also disclose Personal Data we hold if we are under a duty to disclose or share a Data Subject's Personal Data in order to comply with any legal obligation, or in order to enforce or apply any contract with the Data Subject or other agreements; or to protect our rights, property, or safety of our employees, customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.
14.4 We may also share Personal Data we hold with selected third parties for the purposes set out in the Schedule.
Dealing with subject access requests
15.1 Data Subjects can make a formal request for information we hold about them. This must be made in writing. Employees who receive a written request should forward it to the Data Protection Officer immediately.
15.2 When receiving telephone enquiries, we will only disclose Personal Data we hold on our systems if the following conditions are met:
(a) We will check the caller's identity to make sure that information is only given to a person who is entitled to it.
(b) We will suggest that the caller put their request in writing if we are not sure about the caller’s identity and where their identity cannot be checked.
15.3 Our employees will refer a request to their line manager or the Data Protection Officer for assistance in difficult situations. Employees should not be bullied into disclosing personal information.
Changes to this policy
We reserve the right to change this Policy at any time. Where appropriate, we will notify Data Subjects of those changes by mail or e-mail.
